By creating an account, accessing NavEazy, or using the platform (website, app, or any related service), you agree to these Terms of Use (“Terms”). If you do not agree to these Terms, you must not use NavEazy.

NavEazy may modify these Terms at any time. Material changes will be communicated on the platform or by email. Continued use of NavEazy after changes are posted constitutes acceptance of the updated Terms.

NavEazy is a platform that connects:

• boat owners (“Hosts”) who want to offer their vessel for rent;
• renters (“Users”) who want to book a boat for a given period.

NavEazy is not a party to the rental agreement between the Host and the User. Responsibility for the trip, equipment, boat operation, and compliance with applicable regulations rests with the people involved in the rental.

• You must be at least 18 years old and have the legal capacity to use NavEazy.
• You agree to provide accurate, complete, and up-to-date information when creating your account.
• You are responsible for keeping your credentials confidential and for all activity carried out through your account.
• NavEazy may suspend or close any account in the event of non-compliance with these Terms or behavior deemed inappropriate, fraudulent, or dangerous.

You agree to use NavEazy responsibly and in compliance with applicable laws. Without limitation, you must not:

• Post false, misleading, or incomplete information;
• Use NavEazy for illegal, fraudulent, or harmful purposes;
• Bypass security features or attempt to access unauthorized areas of the platform;
• Infringe on the privacy, reputation, or rights of another user;
• Use NavEazy to promote competing services or services unrelated to boat rentals.

Hosts may create listings describing their boat: vessel type, location, photos, description, equipment, capacity, terms, and pricing.

• Renters are responsible for reviewing listing information and asking the Host any questions before booking.
• Bookings are made through NavEazy under the displayed terms (instant confirmation or Host approval).
• Once a booking is confirmed, a rental agreement is deemed to be concluded between the Host and the renter.
• Cancellation and modification policies are provided at booking time or within the relevant listing.

NavEazy uses a third-party payment provider to process transactions securely.

• The renter pays the booking amount and any NavEazy service fees at the time of confirmation.
• A portion of the amount is the Host’s payout, while the remainder covers platform fees, taxes, and applicable commissions.
• A security deposit or damage deposit may be required for certain rentals to cover potential damage or insurance deductibles.
• Deposit payout, holds, or refunds are described in the booking terms and may depend on the situation (incident, damage, dispute, etc.).

NavEazy acts as a technical intermediary by providing a platform that connects Hosts and renters.

• NavEazy does not guarantee the availability, condition, compliance, or actual safety of listed boats.
• NavEazy does not supervise trips or operate vessels.
• NavEazy cannot be held liable for:
  • property damage or personal injury occurring during a rental;
  • a user’s failure to comply with applicable boating regulations;
  • inaccurate or misleading information provided by a Host or renter;
  • any agreement or arrangement made outside the platform.

To the extent permitted by applicable law, NavEazy’s liability is limited to the amount of service fees paid by the relevant user for the booking at issue.

By using NavEazy, each Host and renter acknowledges they are responsible for their own compliance with applicable laws, regulations, and standards (including boating, tax, and insurance requirements).

• Hosts must:
  • Hold the necessary authorizations to offer their boat for rent;
  • Maintain the vessel in good working condition and compliant with applicable safety standards;
  • Clearly inform renters of onboard rules, navigation areas, and usage limits;
  • Comply with any reporting and tax obligations related to generated income.
• Renters must:
  • Respect the boat’s maximum capacity and safety instructions;
  • Hold any required licenses/permits to operate the vessel, if applicable;
  • Use the vessel prudently and in accordance with applicable regulations;
  • Report any incident or damage occurring during the rental without delay.

Photos, descriptions, reviews, comments, and other content posted on NavEazy remain the property of their authors. However, authors grant NavEazy a non-exclusive, worldwide, royalty-free, and transferable license to use such content for platform operations (display, listing promotion, etc.).

NavEazy may moderate, hide, or remove any listing, review, or content deemed inappropriate, illegal, misleading, or contrary to these Terms.

NavEazy collects and processes certain personal data necessary to operate the platform (account creation, bookings, payments, support, etc.).

By using NavEazy, you consent to this processing in accordance with the applicable Privacy Policy.

NavEazy may, at its sole discretion, suspend or terminate a user’s access to the platform, including in cases of:

• Violation of these Terms;
• Fraudulent, dangerous, or inappropriate behavior;
• Multiple serious reports from other users;
• Repeated non-compliance with safety rules or applicable regulations.

Terminating your account does not automatically cancel obligations already incurred (amounts due, ongoing disputes, etc.).

These Terms are governed by and construed in accordance with the laws of the Province of Québec and the laws of Canada, without regard to conflict of laws principles.

In the event of a dispute, the parties will first attempt to resolve it amicably. Failing that, any dispute related to the use of NavEazy may be brought before the competent courts of the appropriate judicial district in Québec, subject to any mandatory applicable rules.
